These Terms of Use (“Terms”) govern your access to and use of the CPSCount website at cpscount.com and all associated services, features, and content (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is available to users of all ages. If you are under 13 years of age (or the applicable age of digital consent in your jurisdiction), you may use the Service only with the consent and supervision of a parent or legal guardian. By creating an account, you represent that you meet this eligibility requirement.

2. User Accounts

You may create an account using email and password or through Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and to update it as necessary.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in cheating or manipulation of scores, or are used for any unlawful purpose. You may delete your account at any time through the Account settings page.

3. Acceptable Use

When using the Service, you agree not to:

• Use automated scripts, bots, auto-clickers, or any software to artificially inflate click speed scores or manipulate leaderboards
• Attempt to exploit, bypass, or interfere with our anti-cheat validation systems
• Submit fraudulent or manipulated scores to any leaderboard
• Create multiple accounts to circumvent bans, manipulate rankings, or abuse the referral system
• Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure
• Attempt to gain unauthorized access to other users’ accounts or to our systems
• Use the Service for any illegal, harmful, or abusive purpose
• Reverse engineer, decompile, or disassemble any part of the Service

4. Virtual Currency (Click Coins)

Click Coins are a virtual currency earned through using the Service. Click Coins have no real-world monetary value and cannot be exchanged for cash, transferred between accounts, or sold to third parties. Click Coins may be used solely to unlock cosmetic features within the Service, including themes, cursor trails, and badges.

We reserve the right to modify the earning rate, pricing, or availability of Click Coins and items purchasable with Click Coins at any time. In the event of account termination for Terms violations, all accumulated Click Coins and purchased items may be forfeited.

5. Leaderboards and Scores

Scores submitted to public leaderboards are visible to all users. We employ automated anti-cheat systems to detect and remove fraudulent scores. We reserve the right to remove any score, disqualify any user from leaderboards, or reset leaderboard data at our sole discretion if we determine that scores were achieved through prohibited methods.

6. Intellectual Property

All content, design, code, graphics, logos, and trademarks on the Service are owned by CPSCount or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

By submitting scores, usernames, or other content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to display such content on leaderboards and in connection with operating the Service.

7. Third-Party Services

The Service uses third-party providers including Google Firebase for authentication and data storage, Google Fonts for typography, Cloudflare for content delivery and security, and Font Awesome for icons. Your use of these third-party services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

CPS testing involves repetitive physical actions. We do not provide medical advice. If you experience pain, numbness, or fatigue in your hands, wrists, or forearms while using the Service, stop immediately and consult a healthcare professional. You use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CPSCount and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless CPSCount and its operators from and against any claims, liabilities, damages, losses, and expenses arising out of your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Modifications to Terms

We may revise these Terms at any time by updating this page. The “Last updated” date at the top indicates the most recent revision. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.
